I have a hex file to program a PIC24FJ256GB110 which I do with an ICD3 the revision code it returns from an older board is 00003 from the newer board 00004. This implies the silicon has changed. The code works in the 00003 board but not the 00004 board, as I am now fault finding the boards could this be a reason?

I haven't used the part in a while, but it should be just a case of setting the configuration bits correctly. You don't say what compiler you are using so I can't give a code example, but your compiler manual should let you know (the commands will probably be at the end of the include file)
Also, you are better off reading the 30F family reference manual (Section 7 is the Oscillator) as it's far more detailed than the datasheet.
If you let us know which compiler and maybe post the code you have already tried it would help give a more specific answer (e.g. a code example)
I notice in the table below the FPR bits are dashed out for the FRC without PLLoption, even though note 1 says the pin function is dependent on these bits (if so, how should they be set?) This seems suspicious, I think I would raise a support ticket with Microchip to see what they have to say on the matter.
It is NOT setup to power the target circuit from the ICD 3.
AN910 is a good reference on programming a PIC. It's worth a read, especially if you're having problems.
That being said, the most reliable way I know of to program PICs is to power down (i.e. disconnect the power source) and allow the programmer to provide power to the device.
There should be no problem powering your circuit from the ICD3. If there is (i.e. there's other load on the rail that the ICD3 cannot handle) then you may need some circuitry to isolate the rest of the VDD rail from the programming header (schottky diode or something similar) to facilitate programming.

The usual place to find the difference between silicon revisions is the errata sheet. For example the following document seems to cover that device:

It appears 03h was the code for revision A5 and the code 04h indicates revision A6. However unless I've missed something looking through that I can't see any known issues addressed or introduced with A6 that are different to A5.
Presumably though something was changed and it certainly could be your problem. It might be worth asking Microchip what was changed between revisions, I've found them helpful and responsive in the past even if you're a low-volume customer.
